Batterer’s Intervention Classes

Batterers’ Intervention Program (BIP) is a program that we often ask our clients to attend, usually as part of our strategy in a domestic violence case. Voluntarily participating in BIP can play a vital role in negotiating a positive outcome in your assault family violence case. Involvement in the BIP program shows the prosecutor that the your are taking the charge and situation seriously. The content and activities in BIP provide at least some assurance to the prosecutor that the alleged violent behavior won’t happen again. BIP is usually an 18 week program.

Anger Control Classes

As part of our strategy for domestic violence or other assault cases we will often ask our clients to enroll in an Anger Control Class. Anger is a healthy emotion, but is not as easily controlled by all people resulting in relationship and health issues. Anger Control Classes are designed to give our client’s an understanding of the source of their anger and how to manage it. This shows the prosecutors or jurors that you are proactive and regardless of how you find yourself charged with a criminal case, you are willing to take action to get your life back on track.

DWI Education Classes

DWI Education Classes are used part of our strategy for Driving While Intoxicated cases. For first time offenders we ask that clients complete the basic 12 hour course. We ask that clients accused of DWI Misdemeanor Repetition (Second DWI) or DWI with BAC 0.15 or Higher take the DWI Repeat Offender Course. The goal of these classes help attendees understand the risk of DWI and provide alternative strategies to getting behind the wheel drunk. It is important to understand that by taking this course you are not admitting guilt, you are just being proactive in your case!

Texas Drug Offender Education Program

If you are facing a drug related charge, as part of our strategy we may ask you to take TXDOEP. This is a typical 10-12 hour course designed to help educate on drugs and their consequences. We will also ask any client who has been accused of a drug related crime to complete 3 CLEAN Urinalysis Tests. Theft Intervention Program (TIPS)

For misdemeanor theft cases, such as shoplifting, we ask our clients to take the Theft Intervention Program. This is a relatively short class. Upon completion you get a certificate that you should provide to your attorney. Taking the Theft Intervention Class does not constitute an admission of guilt. Rather, it helps your attorney communicate to the prosecutor that you are taking your theft charge seriously, and taking TIPS shows you are proactive.

Community Service

In most criminal cases we will ask clients to take the proactive measure of doing community service. This does not mean that you are admitting guilt. Instead it shows the prosecutor that your are working to improve and be a more productive member of society. Some clients say that they do not have time for this part of the strategy. We cannot stress enough that your criminal case needs to be a top priority. Doing community service before your case is resolved likely saves you time and money in the long run. Polygrapher Information

Lie detector tests or polygraphs are not generally admissible in Texas criminal courts. However, polygraphs can be useful tools for treatment or preparing your case for presentation to a prosecutor or grand jury. Like other service providers, you should not contact a polygraph provider until you have spoken with your criminal defense attorney. Statements made during the exam or in the pre-testing interview can be used against you unless the polygraph provider has entered into an “agency agreement” as a part of your criminal defense team.

What is this “Strategy Letter”?

What is it?
In most of our criminal cases we have clients perform certain services before trying to negotiate with the prosecutor. Engaging in services does not mean you are admitting “guilt” in your criminal case. Instead, it shows the prosecutor you are taking the case very seriously, and you are willing to take the steps that are necessary to address their concerns. You should provide verification of completion to your criminal defense attorney. You should never communicate directly with the prosecutor.

Is this required by the Court?
If you are here because you received a “Strategy Letter” from Cofer Law then you are not yet required to engage in these services by the Court. The advice you received in your letter is intended to give you the best chance of having a favorable outcome in your case. We understand that these services take time and money. However, your criminal case should be your top priority, because if your case is not handled properly you may be required to engage in these services and more! By taking a proactive approach to your case you are helping your criminal defense team better negotiate on your behalf.

When is my next court date?

First, you should check in with your bondsman or Tarrant County Pretrial Services to determine when you next court date is.
Second, you should remain in contact with your criminal defense attorney. If you are a client of Cofer Law you can login to your MyCase Account to view your calendar.

Third, you can check your court dates on the Tarrant County Criminal Court Docket System.

Calling the court should be your last resort. If you cannot reach your attorney’s office to determine when you have a court date you should consider whether this is the level of communication you deserve from your lawyer.

What is going to happen at court?

What to do:

First, arrive early!

Second, go into the courtroom and check in with the Court’s bailiff. This will ensure the Court knows you are present. Your attorney may also consult with the bailiff to find out if you have checked in.

Third, sit on the benches in the courtroom and wait for the Court to call your name. This is the time that the judge or court-staff is officially checking the “docket.” If you do not answer when your name is called, the Court may forfeit your bond and issue a warrant for your arrest.

Finally, wait for your attorney. Don’t worry, your lawyer will be there or the Court will excuse you. Tarrant County has 20 criminal courts, and your lawyer likely has court settings in multiple courts. So, it can take a while for an attorney to reach all of the scheduled court dates.

What will happen:

It depends… You should be in contact with your lawyer before your court date. During a busy morning of running dockets is not the time you want to speak with your attorney about your case for the first time.

It may be frustrating, but your case may be “reset” several times. This could be for a variety of reasons, including: your attorney needs time to investigate; you have not completed services or tasks your attorney asked you to do; or it may just be because the State has not made an appropriate plea offer.

If your case is going to trial, your lawyer should have met with you extensively to speak with you about this. If your case is going to result in a plea agreement, this may take place at any of your court dates. Just remember, plea negotiations depend on both you and the State agreeing.

Should I bring witnesses to court?

Generally, no. You will usually have court when a long list of other cases are also scheduled for court. So, the prosecutor does not likely have the time to speak with your witnesses. Also, the courthouse is not a good place for your attorney to interview witnesses. If you want your lawyer to speak with witnesses then write down the witnesses contact information and their contact with your case. Then provide this to your attorney.
Communicating possible witnesses to your attorney is very important. Do this as early in the case as possible. Your lawyer needs time to interview these witnesses and determine whether they will be useful in your defense. Your lawyer also needs to decide when these witnesses will be most helpful. Some witnesses are useful only at trial and others can help your case get resolved without trial.

When can I see the evidence?

State Produced Evidence
The law in Texas does not allow your attorney to give you copies of the documents or media produced by the State. However, you can schedule a time to visit your attorney’s office and view all of the evidence available. Your lawyer is supposed to redact or black-out some information in the police reports and statements. Once you have reviewed the evidence produced by the State you should have a conversation with your attorney about the case. During this conversation you should point out any inaccuracies and provide information to verify the correct information.
Your Attorney’s Investigation
Other than very limited circumstances, your lawyer should make any evidence uncovered during their investigation available to you. At CoferLaw we attempt to send our clients copies of anything we recover during our investigation. We also provide detailed summaries of all of the evidence in a case. How long will my case take to finish?

Depending on the facts and circumstances of your case, the time can vary greatly. For complex felony cases, it is not unusual for cases to take more than a year. Most relatively simple misdemeanor cases are resolved in a few months. If your case is going to trial that can make the process take much longer. The trial schedule for each court varies greatly. Being accused of a crime can be frustrating and frightening. You and your attorney should be focused on getting the best possible outcome, instead of hurrying through the case.

Will my case be on my record?

This depends on the final disposition of your case. If your case is dismissed you may have the opportunity for an expunction. If you complete deferred adjudication community supervision, then you may be eligible for an “order of non-disclosure” to seal the record. Before you enter a plea on your case you need to have a conversation with your attorney about what impact the plea will have on your criminal record. Be sure you understand completely what your attorney is explaining. One important thing to remember is that criminal history does not go away on its own. You must take action to have records expunged or sealed.
